By accessing our website, placing an order, or purchasing from Nuttopia, you agree to be bound by the following Terms of Service (“Terms”). Please read them carefully.

1. ELIGIBILITY

You must be at least 18 years old or have parental consent to purchase from Nuttopia. By placing an order, you represent that you meet this requirement.

Nuttopia produces and sells:

• Nut Cakes
• Nut Brittles
• Chocolate Clusters
• Chocolate Rounds
• Seasonal & Limited-Edition Specialty Items
• Gift Boxes & Assortments

 

All products are handcrafted food items and subject to limited availability.

Nuttopia reserves the right to:

• Modify or discontinue any product without notice
• Limit quantities per order
• Refuse service to anyone for any lawful reason

3. PRICING & PAYMENTS

• All prices are listed in USD
• Prices are subject to change without notice
• We accept major credit/debit cards and approved digital wallets
• You authorize Nuttopia to charge your selected payment method at checkout

Nuttopia is not responsible for bank fees, card processing fees, or declined transactions.

4. ORDER ACCEPTANCE & CANCELLATIONS

Orders may only be canceled within 2 hours of purchase if the order has not entered production or shipping.

Once an order is in production or shipped, it cannot be canceled or changed.

5. SHIPPING & DELIVERY

Nuttopia is not responsible for:

• Carrier delays
• Weather-related disruptions
• Incorrect addresses provided at checkout
• Theft after confirmed delivery
• Heat-related melting of chocolate during transit

Risk of loss transfers to the customer once the order is handed to the shipping carrier.

6. RETURNS & REFUNDS

Nuttopia’s Return & Refund Policy is incorporated into these Terms.
All food products are final sale unless damaged, defective, or incorrect upon arrival.

7. FOOD ALLERGY & SAFETY DISCLAIMER

Nuttopia products may contain or be produced in facilities that handle:

• Peanuts
• Tree Nuts
• Dairy
• Soy
• Chocolate

Customers with allergies assume all risks when purchasing. Nuttopia is not liable for allergic reactions when ingredient disclosures are provided.

8. INTELLECTUAL PROPERTY

All website content, including but not limited to:

• Brand name
• Logos
• Product names
• Packaging designs
• Photos, videos, and marketing materials

are the exclusive intellectual property of Nuttopia LLC and may not be copied, reproduced, or distributed without written permission.

 

9. USER CONDUCT

You agree not to:

• Violate any applicable laws
• Submit false refund claims
• Commit chargeback fraud
• Interfere with website functionality
• Abuse customer service communications

Nuttopia reserves the right to terminate access for violations.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Nuttopia LLC shall not be liable for:

• Indirect or consequential damages
• Lost profits
• Personal allergic reactions
• Carrier delivery failures
• Melted chocolate due to transit conditions

Nuttopia’s total liability shall not exceed the amount paid for the product.

You agree to indemnify and hold Nuttopia LLC harmless from all claims arising from:

• Violation of any laws or regulations

 

12. FRAUD PREVENTION

Nuttopia reserves the right to:

• Cancel suspected fraudulent orders
• Report abuse to payment processors
• Block repeat offenders

• Delivery carriers

Nuttopia is not responsible for outages, errors, or failures caused by third parties.
